MEMORANDUM OPINION
THIS MATTER came before the Court on Defendant American Yacht Harbor, Inc.'s ("Yacht Harbor") Motion for Partial Summary Judgment. This action involves a claim by Plaintiffs Richard and Kathryn Fisher ("the Fishers") that Yacht Harbor should be liable for injuries they sustained during an alleged attack by Defendant Chris Behan ("Behan"). To rule on the Motion for Summary Judgment, the Court must decide two related issues.
