Elwood G. Gallagher received official notice dated October 3, 1989 that due to a violation of section 1547 of The Vehicle Code on September 17, 1989 his license would be suspended for one year effective November 7, 1989. On October 31, 1989 Mr. Gallagher filed his petition for appeal from the order suspending his operating privileges, and an order was entered directing that a hearing de novo be held on December 12, 1989 at 1:30 p.m., and directing that the said order act as a supersedeas to the suspen*191sion order.
