MEMORANDUM OPINION AND ORDER

GRANADE, District Judge.

This case is before the court on appeal from a decision of the United States Bankruptcy Court for the Southern District of Alabama, Case No. 97-14379. On September 19, 2001, the bankruptcy court issued an order denying the motion of the State of Alabama Department of Human Resources (“DHR” or “the State”) to set aside the bankruptcy court’s May 23, 2001, order, in which the State was held in contempt of the bankruptcy court and found to be in violation of the automatic stay imposed in debtor’s Chapter 13 bankruptcy proceedings.
