In this action plaintiff seeks judgment against defendant in the sum of $400 and1 bases his right to such recovery on the following facts and circumstances:
In the month of November, 1921, plaintiff was a road contractor and had 'been doing road work in Campbell county as a subcontractor under Stevens Bros., a firm of road contractors in St. Paul, Minn.
