This is the second appeal of this case. On the first appeal we reversed the judgment for the reason that the record filed here on appeal 'did not affirinatively show that the circuit court had jurisdiction of the accused. Childers v. Commonwealth, Ky., 239 S.W.2d 255.

On retrial, appellant was again convicted of voluntary manslaughter and sentenced to 21 years’ imprisonment.

In substance, the evidence discloses that on July 18, 1949, the appellant, age 16, went squirrel hunting near his'home in a remote section of Pike county. He carried a shotgun for that purpose. He…
