Cross appeals from a judgment of the Supreme Court (Cobb, J.), entered November 20, 1998 in Albany County, upon a verdict rendered in favor of defendant.
Plaintiff J. Lawson Brown, Jr. (hereinafter plaintiff), an attorney, was involved in an automobile accident in May 1995. He claimed that while driving on Albany-Shaker Road in the Town of Colonie, Albany County, the back of his vehicle was *820struck by a falling tree limb.
