This is a workmen’s compensation case. The referee made the following findings of fact:
“1. Claimant on February 19, 1930, was a cer tified miner, working for Samuel Gabriel, a mining contractor, at the Olyphant Colliery of the Hudson Coal Company.
“2. On that day he charged twelve holes with monabel, a high explosive manufactured by the E. I. duPont deNemours Powder Company.
“3. Three of these holes were wired to be fired by detonators and the remaining nine by time delay fuses cut to different lengths so that upon firing, the three holes with detonators would explode at…
