MEMORANDUM OPINION

(January 5, 2011)

I. Introduction.

Defendant Curtió M. Fredericks requests the suppression of a firearm, ammunition, and casings seized, and statements obtained, from him during the course of an early morning encounter with members of the Virgin Islands Police Department. He posits the warrantless stop, seizure, and search of his person violated his rights under the Fourth Amendment to the United States Constitution and should not be allowed into evidence at trial under the exclusionary rule.
