These are consolidated oases, in which plaintiffs seek the recovery of nearly $2,400,000 in income taxes plus interest thereon, paid for the years 1955 through 1961. They now come before the court on exceptions by the parties to the recommended decision filed by Trial Judge Lloyd Fletcher, on September 20, 1974, pursuant to Buie 134(h), having been submitted to the court on the briefs and oral argument of counsel.
