Appellant, Richard Caudill, hereinafter referred to as defendant, was charged in the District Court, Stephens County, Case No. CRF-73-89, with Embezzlement of Rented Property, in violation of 21 O.S. 1971, § 1464. On September 14, 1973, defendant pleaded guilty and his punishment was fixed at five (5) years’ imprisonment and same being suspended. On July 3, 1974, the District Attorney of Stephens-County filed a motion to revoke the suspended sentence alleging the defendant did not comply with the terms of his suspended sentence in that: (1) The defendant committed the offense of…
