JOHN R. BROWN, Chief Judge:
Defendant was convicted on a charge of bank robbery which occurred in December, 1968 in Tuskegee, Alabama. Before the Court, sitting without a jury, he made no effort to deny the commission of the alleged act. Rather the whole defense was premised on his mental incompetence when the crime occurred, an issue which Defendant raised with his plea of not guilty.
