This is a companion case to Dalstan v. Circle Amusement Co., decided contemporaneously herewith, 130 N. J. Eq. 354. Much of the testimony taken at the final hearing in the Dalstan Case was, by consent of the court below and by stipulation of counsel, made a part of this record and the briefs here are correlated.
