This was an action of covenant, brought to the Circuit Court of Lee county, by James L. Hunt against Ransler Baker, for breach of a covenant of seizin and good right to convey in a deed, and a verdict and judgment for the plaintiff.

In the court below the defendant objected to reading the deed in evidence, on the ground of variance from the one declared on. In the declaration it was alleged that the defendant, for himself, his heirs, executors, etc., covenanted that he was well seized, etc., while the deed produced in evidence contained only this covenant, “ that the party of the first part,…
