Appeal by James Y. Meade and the Town of Fishkill from an order of the Supreme Court, made at the Dutchess Special Term and entered in the office of the clerk of the county of Dutchess on the lltli day of July, 1896, confirming the decision of commissioners in favor of laying out a highway, and also from an order entered in said clerk’s office on the 4tli day of August, 1896, denying their motion to resettle the aforesaid order.

This proceeding was duly instituted in the County Court of Dutchess county. On July 6, 1896, the county judge made a certificate reciting that a motion to confirm the report of the commissioners had been noticed for July 7,1896, and declaring that by reason of his being absent from the State of New York, in the State of Maine, whence he would not return until the month of August, 1896, he was incapable to act in the matter.
