HARPER, Judge.
Appellant was convicted of murder in the first degree, and his punishment assessed at death.
The sole defense of appellant was that he was drunk at the time of the commission of the offense and insane from the use of intoxicants. This issue was fairly submitted by the court in his charge, and in a way that appellant does not complain. In fact, in the motion for new trial there is no complaint of the charge, and all the errors assigned relate to the introduction of testimony, and the selection of.the jury.
