This is a peanut case, and, as regards the subject matter and amount, is rather paltry; but, as regards the questions of commercial law involved, it is somewhat important.
The substance of the transactions between the parties, as shown by the evidence, was, that in the early part of January, 1881, they made an agreement, by which the plaintiff was to sell, according to a sample then shown, to defendant, a quantity, being ten unascertained bags of Virginia shelled peanuts, and to deliver the same on arrival at railroad depot in Chicago; but defendant not to be obliged to take them before the…
