This action was brought by appellee, Hickman, .against appellant, J. W. Sanders, and several other parties, not necessary. to name at this place. It was alleged:

That prior to the 3d day of July, 1918, the defendant Sanders was the owner of tracts of land in Hunt county, Tex., bounded and described, giving the boundaries of two surveys of land. “That on or about said date the defendant Sanders, by warranty deed, for a valuable consideration, conveyed to the plaintiff said tracts of land.
