OPINION

A jury in the court of common pleas returned a $5,000 verdict for plaintiff in her action to recover damages from defendant, a municipal corporation, for personal injuries sus*365tained about nine o’clock on the evening of December 12, 1945, as the result of a fall upon a defective curb allegedly maintained by defendant on the northerly side of Spring Street within the corporate limits of defendant city.

On October 31, 1946, defendant filed motions for a new trial and for judgment non obstante veredicto; and on November 7, 1948, the trial judge entered judgment for plaintiff…
