STAYTOH, Chief Justice.

Appellee brought this action to recover a part of league of land granted to Haney Anderson, who died intestate, leaving five children. It seems to be conceded that the part of the league in controversy, by some voluntary partition between the heirs, became the property of Walter and Wyatt Anderson, two of the children.

There is no question raised on this appeal as to the right of appellee to so much of the land as formerly belonged to Walter Anderson, but that he was shown to be the owner of the interest inherited by Wyatt Anderson is denied.
