This appeal is from the District Court of Gregg County, and is before us on transfer by the Supreme Court.

This suit was instituted by appellant, Nellie Wilhoit, a minor, by next friend, to recover damages for personal injuries sustained in a collision between the automobile which she was driving and an auto-mobile driven by W. A. Clarence. She named W. A. Clarence and the Iverson Tool Company as defendants, alleging that Clarence was an employee of the Iverson Tool Company and acting within the scope of his employment at the time of the accident.
