Hal M. Hirsch, the Chapter 7 trustee of the consolidated estate of Colonial Realty Company, Jonathan Googel, and Benjamin Sisti (the debtors), filed a complaint on July 12,1993 against Michael Marinelli, the defendant. On November 15, 1993, the trustee filed an amended complaint containing four counts. The defendant moves to dismiss the amended complaint, contending that the cause of action in Count I is time barred, and that the trustee lacks standing to bring the causes of action…
