This matter arises out of two separate suits for offset of workers’ compensation benefits. These suits were consolidated by the trial court and remain consolidated on appeal. By summary judgement, the workers’ compensation judge granted one of the Plaintiffs requests for offset while denying jurisdiction to hear the other. From this judgement, both the Claimant and the Plaintiff not receiving the offset appeal.
