Shippen Brothers Lumber Company brought an action against A. M. Jones, to recover' certain lumber to which the plaintiff claimed title. The defendant denied that he was in possession of any lumber belonging to the plaintiff. The jury found for the defendant. The plaintiff moved for a new trial, which was denied, and it excepted.
