MEMORANDUM AND ORDER ON CLASS RECOVERY ISSUES

SKINNER, District Judge.

I have previously found and ruled that under Massachusetts law the defendants violated their fiduciary duties to certain owners of nonvoting stock of the New England Patriots Football Club, Inc. (“Old Patriots”) by arranging a merger of that corporation into a new corporation also called the New England Patriots Football Club, Inc., (“New Patriots”) for their personal benefit.
