After being discharged from deferred adjudication community supervision, J.B.R. sought expunction of his arrest records under Article 55.01(a)(2) of the Texas Code of Criminal Procedure. See Tex. Code Crim.Proc.Ann. art 55.01(a)(2)(West Supp.2015). Although the Texas Department of Public Safety (hereinafter, “DPS”) filed a response in opposition, it neither received notice of, nor participated in, the expunction hearing.
