It is claimed that the trial court erred in refusing to grant the continuance of the trial asked for by the appellant. On November 18, 1908, the defendant entered his plea of not guilty to the offense charged in the indictment, and on that date the ease was set for trial on November 30th. On November 30th, upon the application of the defendant, a subpoena was issued for one Edwards, whom the appellant claimed to be a material witness.
