INTRODUCTION
Plaintiff Three Blind Mice Designs Co., Inc. (“TBM”) and defendant Cyrk, Inc. (“Cyrk”), both produce t-shirts and other apparel imprinted with caricatures of sports referees in the form of three blind mice. Plaintiff files claims under the federal unfair competition statute, section 43(a) of the Lan-ham Act, 15 U.S.C. § 1125(a) and state law.
