*1160Appeal from an order of the Supreme Court, Lewis County (Hugh A. Gilbert, J.), entered July 9, 2008 in a personal injury action. The order, insofar as appealed from, granted the motions of defendants VS. Virkler & Son, Inc. and Town of Martinsburg for summary judgment.
It is hereby ordered that the order so appealed from is unanimously modified on the law by denying in part the motion of defendant VS.
