Appeal from a decree of the Circuit Court of Louisa county, pronounced ~fanuary 9, 1899, in a suit in chancery, wherein the ~tppellee was the complainant, and the appellant was the de~endant.

The bill in this case alleges that appellee is the owner of a tract of land in Louisa county with young fruit trees, grass, and herbage growing thereon; that said land is enclosed by a fence, but not such a fence as is defined by the Code of Virginia to be a lawful fence; that appellant is in the possession and management of adjacent land, with cattle and horses thereon, and has been in the habit of turning said cattle and' horses upon the lands of appellee, and still continues thus to trespass upon him, thereby injuring his fruit trees and destroying his grass and herbage; that inasmuch as…
