This action is brought to determine the rights of certain legatees, residents and citizens of Germany, named in the will of Fritz Shafer. The will was made, and the death of the testator occurred, while this country was at war with Germany; the date of the will being Aipril 23, 1918, and the death of the testator September 4, 1920. On September 15, 1920, ihe will was filed for probate in the county court of Spink county, and thereafter Pauline W. Bastían and Charles J.
