writing for the Court.

William E. Palmer was convicted of seven counts of third-degree assault after an armed stand-off with state troopers that occurred at his home near Sutton. Shortly after Palmer was taken into custody, it was discovered that he was suffering from a ruptured brain aneurysm. Palmer received emergency surgery to repair the aneurysm and was later found legally incompetent to stand trial. A few weeks later, Palmer had recovered sufficiently from both the ruptured aneurysm and the surgery to be found legally competent, although he continued to have no memory…
