1. The Waycross Air-Line Railroad Company undertook to build a spur-track, extending from its main line to a point three or four miles distant therefrom, upon and across the land of the Southern Pine Company of Georgia, without consulting the latter and without resorting to condemnation proceedings to procure a right of way for such track.
