The course of procedure adopted in this matter appears to have been somewhat irregular. A more proper practice would have been, for the customs’ officers and the informers to have set forth their claims to this fund by petitions, to which answers should have been interposed by the government, and. upon the issues thus framed. and the testimony adduced by the respective parties, in support of their allegations, a decree could have been rendered, with less danger of confusion and mistake.
