COLEMAN, District Judge.

Judge.

This case is now before the Court on demurrers to the indictment filed on behalf of each of the five defendants.

The indictment is in three counts. The first count charges that the defendants unlawfully, wilfully, knowingly and feloniously carried aboard an exporting carrier, namely, the Spanish S. ^ S. Motomar, at Baltimore, for export, twenty pounds of platinum, more or less, without first presenting to the Collector of Customs of the Port of Baltimore a license so to do; and the second count charges that the defendants loaded the platinum on the steamship, the…
