The defendant, Damien Grenga (“Grenga”), is charged with two identical counts of making bomb threats in his high school in violation of G.L.c. 269, §14(b). Grenga moves the court to dismiss the indictment against him, arguing that the Grand Jury heard insufficient evidence for issuing the indictment and that his statements in the school constituted protected free speech under the First Amendment to the United States Constitution and Article 16 of the Massachusetts Declaration of Rights.
