This suit was brought by Charles J. Wright against Mrs. Anita B. Stewart, indiyiduaily, and as independent executrix of the estate of John S. Stewart; deceased, and B. N. Garrett, the plaintiff in error herein, upon a promissory note executed by John S. Stewart to Charles J. W-right on February 1, 1921; and secured by deed of trust upon land lying in the Victor Blanco survey in Harris county, Tex.
