This decision reviews the impact of the "speedy trial” laws on the prosecutor’s discretion to reduce charges in order to circumvent the defendant’s right to a trial by jury.
FACTS
The time frames at issue in this speedy trial decision are for the most part accepted by the prosecution and the defense. The defendant was arrested on February 21, 1994 and issued a desk appearance ticket to appear on March 25, 1994.
