{¶ 1} Lorain County Prosecuting Attorney Dennis Will and Assistant Prosecutor Anthony Cilio have filed an affidavit with the clerk of this court under R.C. 2701.03 seeking to disqualify Judge James M. Burge from serving on a three-judge panel in case No. 08CR076222, a capital case pending in the Court of Common Pleas of Lorain County.
{¶ 2} For the reasons explained below, the affidavit is well taken, and Judge Burge is disqualified from serving on the three-judge panel.
