Plaintiff in error was indicted by tbe grand jury of Spalding county, in which the provisions of the act known as the “ local option act ” are in force, with the offense of selling-intoxicating liquor to one O. A. Nunnally. The case was tried in the city court of Griffin. The jury returned a verdict of guilty, on which the court passed judgment, and the defendant made a motion for new trial.
