OPINION

BRETT, Judge:

This is an appeal from the judgment and sentence of the District Court of Seminole County, State of Oklahoma, case No. CR 69-54. The plaintiff in error Jimmy Edg-mon, hereafter referred to as the defendant, was convicted by a jury for the crime of “Larceny From The House”; and his punishment was-set at one (1) year in the State Penitentiary. On December 2, 1969, the defendant filed a Motion for New Trial which was denied, and on December 16, 1969, defendant made an appeal bond in the amount of $2,000.00, and has timely perfected his appeal to this Court.
