Motion against W. B. Fol-mar as county treasurer of Pike county and the sureties on his bond for. summary judgment, as provided ■ by section 10265 of the Code of 1923. The office of county treasurer for Pike county was abolished by the act of September. 15, 1915 (Laws 1915, p. 348), but the record shows that defendant Polmar was appointed to act as county treasurer under the terms of section 322 of the Codé of 1923.
