In this litigation arising out of an automobile accident, Waynell C. Burnette (“the plaintiff”) filed a motion asking the trial court to sanction Teddy Sundeen and El-hame Dauti (“the defendants”) for a discovery abuse. Acting under the authority of Tenn. R. Civ. P. 37.02, the court entered a judgment by default against both defendants and, in the same order, awarded the plaintiff damages of $100,000. The defendants appeal, contending that they…
