I. INTRODUCTION

This adversary proceeding between former debtor New York Skyline Inc. (“Skyline”), the operator of a helicopter simulator on the second floor of the Empire State Building (the “Building”), and its landlord and related entities (together, “ESB”) originally came before me as an appeal by Skyline from a Judgment entered by Bankruptcy Judge Stewart M. Bernstein. On appeal, Skyline argued that the Bankruptcy Court lacked authority to enter the Judgment, and in any event had committed reversible errors on the merits. Skyline argued…
