This was a suit by Charles Collier against Elwood C. Collier, George Pierce, and others, to foreclose a real estate mortgage, executed by Elwood C. Collier and wife to said Charles Collier. Pierce, it was alleged in the complaint, claimed some interest in said real estate, which was adverse, but junior, to the mortgage, and he was made a defendant, *277to answer as to any interest claimed by him.
