Woodward, J.:

The plaintiff brings this action for an absolute divorce, the papers having been served on the 6th day of June, 1901. The parties were married in Michigan on September 10, 1884, and four children have been born to them. The complaint alleges that the parties were residents of the State of Hew York at the time the action was instituted, which allegation is admitted by the answer, and the evidence clearly indicates that they were residents of the State at the time of the commission of the alleged acts of adultery on the part of the defendant.
