Judgment entered March 14,1968, in this habeas corpus proceeding by a former husband against his former wife with respect to custody of their infant son, is modified on the law, the facts and in the exercise of discretion to the extent of vacating that portion of the judgment awarding custody *741to respondent, and remanding the proceeding to Special Term for further hearings before the Justice who presided at the trial of this cause.
