The complaint in this action, dated January 19, 1949, is in three counts. In each it is alleged that the plaintiff has been duly appointed and has qualified as administrator o£ the estate of Charles J. Drumm, deceased. The first alleges that the defendants wrongfully seized about $11,050 belonging to the decedent, the second that the defendants hold that money under an implied trust for the decedent, and the third that the defendants obtained the money by the exercise of undue influence.
