McFarland, Justice:

Petitioner, plaintiff below, sued the defendant below, for damages arising out of an automobile accident, alleging that the defendant negligently caused the death of plaintiff’s wife in' Graham County, Arizona. The action was brought in the Superior Court of Maricopa County. Plaintiff is a resident of New Mexico; defendant, of Texas. Service was obtained on the defendant by compliance with A.R.S. 28-503, the non-resident responsibility statute pertaining to automobile accidents.
