Cobb, Ch. J.-

This action was commenced in the court below for the purpose of foreclosing a mortgage on real estate executed by the defendants, George Mueller and Sophia Mueller, to one ■John Raben, who, after maturity, sold, assigned, and delivered the same, together with the note, to secure which the said mortgage -was given to the plaintiff. The defendant, Ered. Eunke, was made a defendant for the reason that he was the holder of a subsequent mortgage on the same property.
