This case comes before the court upon the application of the plaintiff for judgment upon the verdict of $1,683.33, directed upon the trial of this action in favor of the plaintiff, subject to the opinion of the court at general term.
The action is brought against the defendant as surety for one Mrs. Marshall, a tenant of the plaintiff. The evidence shows clearly that, before renting the premises, the plaintiff required security for the rent; Mrs. Marshall proposed the name of the defendant, a lease was drawn up which bears date April 6, 1867, and which, it must be assumed, as the evidence…
